These are the Terms of Service governing your use of the Jot's services.

Definitions

  • "The Jot" refers to the Jot Discord bot and it's services which operate on Discord.
  • "The Jot Website" refers to this website.
  • "The Developer" or "we" refers to the owner of the Jot and the administrator(s) of the Jot's support Discord server.
  • "You" and "your" refers to you. If you’re using the Jot on behalf of a legal entity, you agree that you have the authority to bind that entity to these terms, and "you" and "your" will refer to that entity.

Summary

Here's a quick, non-exhaustive summary of these terms, to give you a general idea:
  • The Developer is not responsible for links or files you may encounter through the Jot
  • The Developer is not liable for loss of profits, loss of data, business interruption, or harm to you or any person (for example, due to your inability to use the Jot in case of an outage)
  • You'll almost always get 30 days of warning before these terms ever change
  • If you have a dispute, you agree to try to resolve it informally by contacting the Developer, before pursuing formal legal action
  • If you're a Patreon subscriber, you can get the latest month refunded in the event of an issue
  • The Developer may revoke your access to the Jot if these terms are breached

Terms of Service

Acknowledgement
By using the Jot, you agree to be bound by these terms. If you disagree with any part of these terms, then you may not use the Jot.

Termination
The Developer may terminate or suspend your ability to use the Jot immediately, without prior notice or liability, if you breach these terms.

Changes to These Terms
The Developer may modify or replace these terms at any time. If a revision is made the Developer will make reasonable efforts to provide at least 30 days of notice prior to any new terms taking effect.

Links to Other Websites
The Jot and the Jot Website may contain links to third-party web sites or services that are not owned or controlled by the Developer.

The Developer has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Developer shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

You are strongly advised to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Disclaimer
The Jot is provided to you "as is" and "as available" and with all faults and defects without warranty of any kind. The Developer disclaims all warranties, whether express or implied, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

In addition, the Developer does not make any representation or warranty of any kind, express or implied: (i) that the Jot will be uninterrupted or error-free; (ii) as to the accuracy, reliability, or currency of any information or content provided through the Jot and the Jot Website; or (iii) that the Jot's messages are free of viruses, malicious links or other harmful components. Discord users may send malicious files or links which gets logged by the Jot, which is out of the Developer's control. However, the Jot renders links unclickable when suspected to be malicious where possible.

Limitation of Liability
The liability of the Developer under any provision of these terms shall be limited to the amount actually paid by you to the Jot, via Patreon subscription only, during the 1 month preceding the event giving rise to such liability.

In no event shall the Developer be liable for any damages (including, but not limited to, damages for loss of profits, loss of data, business interruption, personal injury or loss of privacy arising out of the use of or inability to use the Jot), even if the Developer has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Governing Law
The laws of Canada, excluding its conflicts of law rules, shall govern these terms and your use of the Jot. Your use of the Jot may also be subject to other local, state, national, or international laws.

Disputes Resolution
If you have any concern or dispute about the Jot, you agree to first try to resolve the dispute informally by contacting the Developer. This can be done by messaging a developer or administrator in the Jot Discord server to initiate private contact.
